Covenants and Restrictions: MacDonald Drive Neighborhood

The premises are conveyed subject to the following easements, rights of way and other matters to the extent they may apply:

  1. There is reserved to Dartmouth its successors and assigns a right of entry and easement over, under, and across the property hereby conveyed for the purposes of maintaining, installing, inspecting, repairing, improving, replacing, constructing, and reconstructing any utilities, included but not limited to water, sewer, storm drain, electric, gas, telephone, or cable TV systems now or hereafter serving the premises herein conveyed, or providing service to other nearby properties whether or not owned by Dartmouth. Said right of entry shall be restricted to reasonable times. Any portion of the surface of land dug up by Dartmouth in exercising the rights herein granted shall be restored by Dartmouth to its original condition. Said right of entry and easement shall continue in full force and effect so long as the utilities systems herein referred to are maintained and operated at their present location.
  2. The drainage, flowage, culvert and other appurtenant easements conveyed by Trustees of Dartmouth College to the Town of Hanover in the Quitclaim Deed for 1991 and recorded in the Grafton County Registry of Deeds on February 8, 1991 in Book 1897, Page 764, and the Quitclaim Deed for MacDonald Drive dated February 4, 1991, accepted by the Town of Hanover on February 4, 1991 and recorded in the Grafton County Registry of Deeds on February 8, 1991 in Book 1897 and Page 768.
  3. As easement for an underground electric distribution system conveyed by Trustees of Dartmouth College to Granite State Electric Co., by Easement Deed dated May 9, 1983, recorded in book 1472 at Page 959.
  4. An easement for anchors, guides, and pole brace locations, conveyed by Trustees of Dartmouth College to New England Telephone and Telegraph Co. and Granite State Electric Co. by Easement Deed dated October 11, 1984, recorded in Book 1523 at Page 738.
  5. Lot 6 is subject to a 25 foot easement from Morrison Road to the premises shown on the Plan as "Dartmouth College Parcel 1" and a 25 foot easement to the premises shown on the Plan as "Dartmouth College Parcel 1", and certain financial obligations related thereto. Reference is made to the Quitclaim Deed from Trustees of Dartmouth College to Spritz, dated May 4, 1989 and recorded in Book 1802 at Page 94, conveying Parcel 1.
  6. Lot 13 is subject to a 30 foot utility easement as shown on the Plan entitled "Dartmouth College, Section A, Grasse Farm, Hanover, N.H., scale 1" = 50', dated May 20, 1981, Proj. No. 1381280", Revised November 30, 1982 and August 15, 1983, by K.A. LeClair Assoc., Inc., Civil Engineers, Hanover, N.H., recorded in the Grafton County Registry of Deeds as Plan #2457 (the "Plan").
  7. Lot 34 is subject to a utility easement conveyed by Trustees of Dartmouth College to the Town of Hanover by Warranty Deed dated October 16, 1984, accepted by the Town of Hanover, November 5, 1984 and recorded in the Grafton County Registry of Deeds on November 8, 1984 in Book 1524 at page 741.
  8. Lot 35 is subject to an easement to the Hanover Water Works Company for water mains, as shown on the Plan.
  9. The owner or owners of each Lot shall automatically become a member of the Grasse Road Homeowners Association, Inc. and shall comply with the articles to Agreement and Bylaws of said association, as they may from time to time be amended, including but not limited to provisions requiring payment of and providing for a lien for unpaid dues and assessments. Reference is made to the Warranty Deed from Trustees of Dartmouth College to Grasse Road Homeowners Association, Inc. dated November 29, 1984, recorded in the Grafton County Registry of Deeds on December 3, 1984 in Book 1527 at Page 277.
  10. Easements for water service curb stops, sewer service stubs and electrical and telephone service as shown on the plan entitled "Utilities 'As-built' 4/30/86" by K.A. LeClair Assoc., Inc. Project No. 40486.
  11. Any other easements, rights of way, or matters shown on the Plan.
